1. Eligibility and acceptance
FitUp is intended only for adults age 18 or older. You may use FitUp only if you can legally agree to these terms in your location. If you do not agree, do not use the app.
2. Exercise risk and personal responsibility
Physical exercise involves risk, including strain, falls, injury, aggravation of an existing condition, and in rare cases serious harm. You are responsible for deciding whether a workout, movement, pace, and environment are appropriate for you. Use adequate space, stable surfaces, suitable clothing, and safe technique.
Stop immediately if you feel pain, faintness, chest discomfort, unusual shortness of breath, or another concerning symptom. Seek emergency or qualified medical help when appropriate. Consider consulting a licensed healthcare professional before beginning or changing an exercise program, especially if you are pregnant, injured, have a medical condition, or have been advised to limit activity.
3. Not medical advice
FitUp provides general fitness information and workout guidance. It is not a medical device, diagnostic service, treatment plan, emergency service, or substitute for advice from a qualified healthcare professional. Workout labels, illustrations, reminders, estimated difficulty, and progress information do not guarantee a result or establish that a movement is safe for every person.
4. Access and no-account design
FitUp is designed to work without a FitUp account. The planned launch offering includes one free workout each day. The selected free workout, availability, catalog, and included features may change over time. Additional workouts and features may require an active Apple-managed subscription when subscriptions are offered in the released app.
5. Planned subscriptions and three-day trial
If offered at launch, eligible users may receive a three-day free trial of FitUp Pro with either the monthly or annual auto-renewable subscription. Planned United States prices are $6.99 per month and $49.99 per year. Apple will show the actual localized price, currency, trial eligibility, duration, and billing terms in the purchase screen; the terms shown by Apple at purchase control.
- Trial eligibility is determined and administered by Apple and may be limited to new or otherwise eligible subscribers.
- Unless canceled, a trial converts to the selected paid subscription at the end of the trial.
- Apple charges your Apple Account and manages renewal, billing, refunds, subscription eligibility, and cancellation through the App Store.
- Auto-renewable subscriptions continue for the selected period unless canceled through your Apple subscription settings before renewal, subject to Apple's displayed terms.
- Deleting FitUp does not by itself cancel an Apple subscription.
You can review or cancel an Apple-managed subscription at Apple's subscription management page. Refund requests and billing disputes are handled under Apple's policies.
6. Acceptable use
You agree not to:
- Use FitUp in a way that violates law or the rights of others.
- Attempt to bypass subscriptions, access controls, technical protections, or catalog integrity checks.
- Reverse engineer, copy, redistribute, resell, or commercially exploit FitUp or its content except where law expressly permits.
- Interfere with the app, website, security, availability, or another person's use.
- Misrepresent FitUp content as medical advice or use the service for emergency response.
7. FitUp content and third-party services
FitUp and its visual designs, workout content, illustrations, software, branding, and related materials are owned by or licensed to FitUp and protected by applicable law. Apple services such as the App Store, Health, iCloud, and watchOS are provided by Apple under Apple's own terms and policies. Their availability and behavior can change outside FitUp's control.
8. Changes, availability, and termination
We may update, correct, suspend, or discontinue features, workouts, catalog content, or platform support where reasonably necessary for safety, security, legal compliance, product improvement, or service operation. We may restrict access when these terms are materially violated. Where appropriate, important changes will be described in the app or on this site.
9. Disclaimers
To the extent permitted by applicable law, FitUp is provided on an “as is” and “as available” basis. We do not promise that every workout is suitable for you, that the service will always be uninterrupted or error-free, or that using FitUp will produce a particular health, fitness, or performance result. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
10. Limitation of liability
To the extent permitted by applicable law, FitUp and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use FitUp. Nothing in these terms excludes or limits liability that cannot legally be excluded, or overrides consumer rights that cannot be waived in your jurisdiction.
11. Apple terms
The released iOS and watchOS apps will be licensed, not sold, and will use Apple's Standard End User License Agreement unless the App Store listing states otherwise. Review the Apple Standard EULA. If these terms conflict with non-waivable Apple App Store requirements, those requirements apply to the extent of the conflict.
12. Updates and contact
We may revise these terms as FitUp evolves. The effective and last updated dates above identify the current version. If a change is material, we will provide notice where reasonably appropriate. Questions can be sent to support@appfitup.com.
